Privacy Policy
1. Who we are (data controller)
The controller of your personal data as an Enki User is Ruslan Madzhara (individual), Ukraine, operating under the "Enki" brand (enki.build). For privacy matters, email [email protected].
2. What data we collect
- Account data via Telegram: Telegram ID, name, username, language, profile photo (if available);
- Content you create: text, images, settings and the structure of your sites;
- Payment data: processed by our payment provider (Stripe/Link, payments in €); we only receive payment confirmation and accounting details (plan, amount, country), not card data;
- Technical data: IP address, request logs, device and browser type, actions within the Service;
- Cookies and similar technologies (see the section below).
3. Why and on what basis (GDPR)
- providing and operating the Service — performance of a contract (Art. 6(1)(b) GDPR);
- billing and fraud prevention — contract and legitimate interest (Art. 6(1)(b), (f));
- security, diagnostics and improving the Service — legitimate interest (Art. 6(1)(f));
- meeting legal and accounting obligations — legal obligation (Art. 6(1)(c));
- marketing messages — only with your consent (Art. 6(1)(a)), which you can withdraw at any time.
4. Payment data
Payments in euros (€) are processed by Stripe via Stripe Managed Payments: the purchase is sold through Link, and Link (Stripe) acts as the Merchant of Record for the transaction. Card details are entered on Stripe’s/Link’s side and are not shared with us; we only receive payment confirmation and the details needed for accounting. Stripe and Link process this data under their own privacy policies.
5. Data from Telegram
Sign-in and interaction with the Service happen through Telegram. We receive the data Telegram provides (ID, name, username, photo if available) for authentication and bot operation. Your use of Telegram is governed by Telegram’s terms and policy.
7. International data transfers
Data may be processed outside your country, including by providers in the EU and other jurisdictions. In such cases we rely on appropriate safeguards under the GDPR (including standard contractual clauses where applicable).
8. How long we keep data
We keep personal data for as long as needed to provide the Service and to meet legal and accounting obligations. After account deletion, data is deleted or anonymised within a reasonable period, unless the law requires us to retain it.
9. Your rights (GDPR)
You have the right to:
- access your data and obtain a copy;
- rectify inaccurate data;
- erasure ("right to be forgotten");
- restrict and object to processing;
- data portability;
- withdraw consent at any time;
- lodge a complaint with a data-protection supervisory authority.
- To exercise these rights, email [email protected].
10. Data of visitors to Users’ sites
For personal data collected through sites created by Users (form leads, customer data), the relevant User (site owner) is the controller and Enki acts as a processor on their instructions. Requests regarding such data should be directed to the owner of the relevant site.
12. Children
The Service is not intended for persons under 16 without a legal representative’s consent. If you believe we have processed a child’s data without a proper basis, please tell us and we will take action.
13. Changes to this Policy
We may update this Policy. Material changes will be notified by reasonable means. The current effective date is shown at the top of the page.
